  2. The role of the family in deceased organ procurement: A guide for Clinitians and Policymakers.Janet Delgado, Alberto Molina-Pérez, David M. Shaw & David Rodríguez-Arias - 2019 - Transplantation 103 (5):e112-e118.
Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...)

The Ranking Argument – Challenging Favourable Comparative Rhetoric about Animal Welfare Law.Christian Rodriguez Perez, Nico Dario Müller, Kirsten Persson & David M. Shaw - 2023 - Leoh - Journal of Animal Law, Ethics and One Health 1.
This article captures and critiques a recurring and prominent political argument against animal welfare improvements in Switzerland which we term the “ranking argument”. This states that Swiss animal welfare law ranks among the strictest in the world, therefore no improvements are called for. This argument was advanced three times by Swiss government authorities in 2022 alone, but also in a case dating back to 1984, to advise the electorate on popular initiatives aiming at animal welfare improvements. We argue that, while (...)

  7. Donation After Circulatory Death: Burying the Dead Donor Rule.David Rodríguez-Arias, Maxwell J. Smith & Neil M. Lazar - 2011 - American Journal of Bioethics 11 (8):36-43.
Despite continuing controversies regarding the vital status of both brain-dead donors and individuals who undergo donation after circulatory death (DCD), respecting the dead donor rule (DDR) remains the standard moral framework for organ procurement. The DDR increases organ supply without jeopardizing trust in transplantation systems, reassuring society that donors will not experience harm during organ procurement. While the assumption that individuals cannot be harmed once they are dead is reasonable in the case of brain-dead protocols, we argue that the DDR (...)

In this work, we present a new approach to solve the location management problem by using the reporting cells strategy. Location management is a very important and complex problem in mobile computing which aims to minimize the costs involved. In the reporting cells location management scheme, some cells in the network are designated as reporting cells . The choice of these cells is not trivial because they affect directly to the cost of the mobile network. This article is focused on (...)

Hansson, Sara Hull, Scott Kim, Bernie Lo, Rebecca Pentz, Laura Rodriguez, Carol Weil, Benjamin S. Wilfond & David Wendler - 2015 - American Journal of Bioethics 15 (9):34-42.
Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

Since it is only five years since the publication of our paper, "Geographical categories: An ontological investigation" (Smith and Mark 2001), it seems somewhat strange to be making retrospective comments on the piece. Nevertheless, the field is moving quickly, and much has happened since the article appeared. A large number of papers have already cited the work, which suggests that there is a seam here that people find worthy of being mined. In this short essay, we first review the paper (...)

    The Anatomy of a Philosophical Hoax.Rebekah Spera & David M. Peña-Guzmán - 2019 - Metaphilosophy 50 (1-2):156-174.
This article reflects upon the state of the philosophical profession vis‐à‐vis a close reading of the hoax perpetrated against the International Journal of Badiou Studies in 2016. This hoax is not a subversive act of disciplinary criticism (as the hoaxers contend). Rather, it is a poorly disguised attempt to enforce a partisan and myopic conception of philosophy and to delegitimize an entire subfield of philosophical production—namely, continental philosophy. The hoax is symptomatic of a deeper problem that plagues the profession today: (...)

Este texto surge de un intercambio epistolar mantenido con David Armstrong a propósito de su libro Universals. An Opinionated lntroduction.

    Algebraization of the Three‐valued BCK‐logic.Francisco M. García Olmedo & Antonio J. Rodríguez Salas - 2002 - Mathematical Logic Quarterly 48 (2):163-178.
In this paper a definition of n-valued system in the context of the algebraizable logics is proposed. We define and study the variety V3, showing that it is definitionally equivalent to the equivalent quasivariety semantics for the “Three-valued BCK-logic”. As a consequence we find an axiomatic definition of the above system.

    Negation and BCK‐algebras.Francisco M. García Olmedo & Antonio J. Rodríguez Salas - 2003 - Mathematical Logic Quarterly 49 (4):336-346.
In this paper we consider twelve classical laws of negation and study their relations in the context of BCK-algebras. A classification of the laws of negation is established and some characterizations are obtained. For example, using the concept of translation we obtain some characterizations of Hilbert algebras and commutative BCK-algebras with minimum. As a consequence we obtain a theorem relating those algebras to Boolean algebras.

Argument from Expert Opinion as Legal Evidence: Critical Questions and Admissibility Criteria of Expert Testimony in the American Legal System.Douglas Walton David M. Godden - 2006 - Ratio Juris 19 (3):261-286.
. While courts depend on expert opinions in reaching sound judgments, the role of the expert witness in legal proceedings is associated with a litany of problems. Perhaps most prevalent is the question of under what circumstances should testimony be admitted as expert opinion. We review the changing policies adopted by American courts in an attempt to ensure the reliability and usefulness of the scientific and technical information admitted as evidence. We argue that these admissibility criteria are best seen in (...)

Throughout the Old Testament, the stories, laws, and songs not only teach a way of life that requires individuals to be moral, but they demonstrate how. In biblical studies, character ethics has been one of the fastest-growing areas of interest. Whereas ethics usually studies rules of behavior, character ethics focuses on how people are formed to be moral agents in the world. This book presents the most up-to-date academic work in Old Testament character ethics, covering topics throughout the Torah, the (...)

Democracy is not naturally plausible. Why turn such important matters over to masses of people who have no expertise? Many theories of democracy answer by appealing to the intrinsic value of democratic procedure, leaving aside whether it makes good decisions. In Democratic Authority, David Estlund offers a groundbreaking alternative based on the idea that democratic authority and legitimacy must depend partly on democracy's tendency to make good decisions.Just as with verdicts in jury trials, Estlund argues, the authority and legitimacy (...)

    Moral Consciousness and Communicative Action.David M. Rasmussen - 1993 - Philosophical Quarterly 43 (173):571.
This long-awaited book sets out the implications of Habermas's theory of communicative action for moral theory. "Discourse ethics" attempts to reconstruct a moral point of view from which normative claims can be impartially judged. The theory of justice it develops replaces Kant's categorical imperative with a procedure of justification based on reasoned agreement among participants in practical discourse.Habermas connects communicative ethics to the theory of social action via an examination of research in the social psychology of moral and interpersonal development.
